In-house legal services for Growth Intelligence

Growth Intelligence legal services case study - TLD

Business background

Growth Intelligence is a UK Artificial Intelligence (AI) company that helps businesses get more from their marketing budgets. By combining machine learning and millions of proprietary data points on every business in the economy, Growth Intelligence is able to predict which prospects are most likely to buy from its clients and how much money they will spend.

Built into the technology is also a solution that predicts the extent to which business prospects have been impacted by Covid-19, allowing Growth Intelligence clients to protect their brand reputation and avoid financial loss by identifying the live trading status of businesses.

Legal services required

Typically, says Tom Gatten, CEO at Growth Intelligence, the company’s clients are at the larger end of the size spectrum— large financial institutions, such as American Express for example. Many have stringent vendor onboarding processes and requirements for comprehensive legal terms.

Given that Growth Intelligence predictions are bespoke to each client, with a client’s data being used as part of the AI build for each client, a key aspect of Growth Intelligence’s service is managing data privacy and data security. Typically, he notes, lawyers on both sides get involved.

Another frequent requirement arises from the sheer novelty of what Growth Intelligence provides its clients, he adds. Relatively few clients have an in-depth familiarity with AI
in a marketing context, which adds complexity to contract negotiations. Intellectual property considerations are a typicalexampleof this, saysGatten.

“As the business grew, we increasingly found ourselves needing a smart, business-savvy lawyer who could successfully stand up to the top law firms and in-house legal teams that our clients generally possessed,” recalls Gatten. “The challenge was obvious: not only are such people rare, they’re generally not available part-time.”

Why The Legal Director?

Enter Amanda Heath, a client legal director at The Legal Director. With a wealth of relevant experience, part-time working is exactly the business model she operates. The fit was obvious. “The recommendation was made by an accountant who was working with Growth Intelligence at the time,” she explains. “I’d worked with her at another client, and she knew my work well.”

Legal services provided

Coming on board almost immediately, Heath has worked with Growth Intelligence ever since, her volume of work increasing as the business has grown. Amanda now provides Growth Intelligence with in-house legal services for three to four days a month. As expected, negotiations with Growth Intelligence clients comprise a significant proportion of the work, but not all of it.

For example, she explains, Growth Intelligence recently undertook another funding round, with which she was closely involved, instructing and briefing the relevant external lawyers.

Another example is working with the data science teams: total clarity is required in terms of the permissible uses to which Growth Intelligence can put the data, she explains.

In addition, Amanda has supported the growth of the company: building a strong compliance structure within the company’s operations, protecting the company’s intellectual property and, as a 30-strong company, mostly comprising
a sales team, engineers and data scientists, providing legal support in human resources.

Benefits to the business

For Growth Intelligence, the advantages of working with The Legal Director are threefold.

First, cost-effectiveness. With a legal resource working three to four days a month—and which needn’t be whole, complete days at a time—there’s no unnecessary expenditure.

Second, a high level of expertise and familiarity with the business—invaluable characteristics for any lawyer working with a business like Growth Intelligence. “Amanda knows how we work, and what we want to achieve,” says Gatten.

“She understands how to help us close deals, and understands the risks that it is important for us to minimise. She’s one of the team.”

And third, speed of response—which is vital in a business such as Growth Intelligence. “Effectively, I’m on call, available to work with the marketing, sales, operations and human resources teams as required.

When legal expertise is required, the GI team just pick up the phone or drop me an e-mail, and we take it from there,” concludes Heath. “My role really isn’t tightly defined,” she sums up. “Essentially, it’s to do whatever needs doing on the legal front.”
