TLD’s Sophie Freeman joined the debate on BBC Radio 4’s Front Row last night, as journalist Carolyn Atkinson explained how the misuse of non-disclosure agreements (NDAs) in film and television casting is now being challenged.
Thanks to Sophie’s intervention, and her collaboration with the Personal Managers Association (PMA), agents are now able to push back on these NDAs.
The change is starting to correct a longstanding imbalance of power between actors and production companies that leaves performers isolated: fearful of prejudice and lost opportunity if they fail to sign.
Sophie’s solution was simple: a standard document that was sent back to the producer alongside a questionable NDA.
This “annex” acknowledged the value of truly confidential information yet clearly outlined the key points which would make the NDA unenforceable.
Collaboration with the PMA ensured widespread adoption by agents (de-risking engagement). The PMA – with Sophie’s support – subsequently worked with Equity to create industry Guidance, helping to educate and reassure actors their needs are recognised and respected.
